Art by the Yard, LLC (D.B.A. Art Experience.us) is pleased to host Fun Night Out Paint Classes and BYOB Private Paint Parties. Please note that you ("Client") are subject to the following terms & conditions. Your payment serves as an agreement to the following:
CANCELLATIONS:
As Art by the Yard, LLC ("D.B.A. Art Experience.us") can not control Client attendance, refunds will not be made. However your date and time can be rescheduled.
Art by the Yard, LLC ("D.B.A. Art Experience.us") recognizes that plans can and do change, sometimes on short notice. If there is a change in client's plans, e.g. cancellation or postponement of the BYOB Painting Party, Art by the Yard, LLC ("D.B.A. Art Experience.us") will take reasonable steps to book a substitute date. In the event, however, if Art by the Yard, LLC ("D.B.A. Art Experience.us") is unable to do so, a store credit for the unused amount will be issued to the Client with a 1 year validation limit to the date of original purchase date.
As sometimes things happen outside of our control (ie. loss of power, employee sickness, ect) Art by the Yard, LLC ("D.B.A. Art Experience.us") reserves the right to reschedule a Fun Night Out Paint Class or BYOB Private Paint Party. It is at the discretion of Art by the Yard, LLC ("D.B.A. Art Experience.us") to decide whether the event will be subject to rescheduling. A representative will contact the Client with as much notice as is possible.
ALCOHOLIC BEVERAGES:
Art by the Yard, LLC ("D.B.A. Art Experience.us") does not serve or provide alcoholic beverages, however the Client may choose to bring store bought alcoholic beverages with them and consume them on premise if the Client agrees to abide by the following terms and conditions:
a. Alcohol may be served to persons over the age of 21 under the terms and conditions consistent with the applicable laws of the State of Missouri as long as the Client abides by the following rules:
i. Client shall take full responsibility for and hold Art by the Yard, LLC ("D.B.A. Art Experience.us") and its facility partners harmless from ALL liability arising from the serving and consumption of alcoholic beverages. You may bring your own alcohol provided you meet applicable alcohol laws of the State of Missouri.
ii. (For Private Paint Parties) If caterers are to serve or provide a bartender to serve alcoholic beverages, the caterer shall provide to the partner facility management a certificate of insurance evidencing a Liquor Liability Policy at least seven days prior to event date.
INDEMNIFICATION:
Client agrees that it shall indemnify, defend and hold harmless Art by the Yard, LLC ("D.B.A. Art Experience.us") and its owners, staff, officers, trustees, director, and facility partners from and against any and all damage, loss, claims, suits, demands, actions, fines, damages, liabilities, costs and expenses (including, without limitation, reasonable attorneys' fees) arising out of or in connection with damage to property or injury to persons (including death) which arise out of client's participation in or activities that take part before or after a Fun Night Out Paint Class or BYOB Private Paint Party, including any acts or omissions of Client, its agents, contractors, employees, invitees, servants or subcontractors.
Client shall provide Art by the Yard, LLC ("D.B.A. Art Experience.us") immediate notice of any injury or damage to persons or property in, to or around the BYOB Private Paint Party location of which it is aware.
PRIVACY POLICY:
We may use your image on our website and promotional materials without any compensation. You feel good that your happy face is helping a local business thrive.
